Metabyl AI ("we," "us," or "our") is committed to protecting your privacy. This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you use our recipe generation mobile application ("Metabyl AI" or the "App") available on the Apple App Store. By using the App, you agree to the terms of this Privacy Policy. If you do not agree with the terms of this policy, please do not use the App.

We collect information you provide directly to us, information collected automatically, and information from third parties, as described below:

1.1 Personal Information

When you use the App, we may collect the following personal information:

• Account Information: When you create an account, we may collect your name, email address, and a password.
• Health and Dietary Information: To provide personalized recipe suggestions and macro/micro recommendations, we may collect information about your health goals, dietary preferences, allergies, and other relevant details you choose to provide (e.g., weight loss goals, fitness level, or specific dietary restrictions).
• User Content: Any additional information you input, such as favorite recipes, meal plans, or feedback.

1.2 Automatically Collected Information

We may collect certain information automatically when you use the App, including:

• Usage Data: Information about how you interact with the App, such as features used, time spent on the App, and navigation patterns.
• Device Information: Information about your device, including device type, operating system, unique device identifiers, and IP address.
• Analytics Data: We use third-party analytics tools to collect aggregated data about App usage to improve our services.

1.3 Information from Third Parties

If you choose to connect third-party services (e.g., fitness trackers or health apps) to the App, we may collect information from those services, such as activity data or nutritional preferences, subject to the third party's privacy policies.

We use the information we collect to:

• Provide personalized recipe recommendations and macro/micro nutrient suggestions based on your health goals and dietary preferences.
• Operate, maintain, and improve the App's functionality and user experience.
• Communicate with you, including responding to inquiries, sending updates, or providing customer support.
• Analyze usage trends to enhance the App's performance and develop new features.
• Ensure the security of the App and protect against fraud or unauthorized access.
• Comply with legal obligations and enforce our terms of service.

3. How We Share Your Information

We do not sell, rent, or trade your personal information to third parties for marketing purposes. We may share your information in the following circumstances:

• Service Providers: We may share your information with third-party service providers who perform services on our behalf, such as hosting, analytics, or customer support. These providers are contractually obligated to protect your information and use it only for the purposes we specify.

4. Sending Shopping Lists to Kroger (optional, user-initiated only)

When you choose to send a shopping list from Metabyl to Kroger for delivery or pickup, Metabyl sends the following data to Kroger via their public API (api.kroger.com):

• Your food item names and quantities (e.g., "boneless chicken thighs, 2 lb")
• Your chosen Kroger store location ID
• Your ZIP code (only when looking up nearby Kroger stores)

We do not send to Kroger:

• Any health information you have shared with Metabyl
• Your medical conditions, dietary restrictions, or allergens
• Your daily rhythm check-in data or rhythm scores
• Your meal plans, recipes, or any Metabyl-specific content
• Your personal information beyond the food items themselves

Your Kroger sign-in is managed by your device's secure auth session (Apple's ASWebAuthenticationSession on iOS, Chrome Custom Tabs on Android). Metabyl never sees your Kroger password and does not store your Kroger credentials on our servers. Your Kroger access token is stored only locally on your device, encrypted by the operating system.

You can disconnect Metabyl from your Kroger account at any time through the app's Settings → Delivery Services → Kroger → Disconnect, or by revoking the connection from your Kroger account settings.

Kroger's handling of the data you send is governed by Kroger's privacy policy at kroger.com/privacy-policy.

5. Data Security

We implement reasonable technical and organizational measures to protect your personal information from unauthorized access, use, or disclosure. These measures include encryption, access controls, and secure servers. However, no method of transmission over the internet or electronic storage is 100% secure, and we cannot guarantee absolute security.

6. Data Retention

We retain your personal information only for as long as necessary to fulfill the purposes outlined in this Privacy Policy, unless a longer retention period is required or permitted by law. For example, we may retain your account information until you delete your account or stop using the App. Usage and analytics data may be retained in an anonymized form for longer periods to improve our services.

7. Your Choices and Rights

You have certain rights and choices regarding your personal information:

• Access and Update: You can access and update your account information and preferences through the App's settings.
• Delete Your Data: You can request deletion of your account and associated personal information by contacting us at support@metabyl.com. Note that some information may be retained as required by law or for legitimate business purposes.
• Opt-Out: You can opt out of receiving promotional communications by following the unsubscribe instructions in those communications.
• Health Data: You can choose not to provide health or dietary information, but this may limit the App's ability to provide personalized recommendations.

If you are located in certain jurisdictions, such as the European Economic Area (EEA) or California, you may have additional rights under applicable data protection laws, including:

• The right to access, correct, or delete your personal information.
• The right to restrict or object to certain processing of your data.
• The right to data portability.

8. Users Under 18 + State Age-Verification Laws

Metabyl is designed for adults. The app's clinical framework — the Rule of Metabolic Life, the C.L.E.A.N. food framework, and the rhythm-system recommendations throughout — are built around adult metabolic patterns and adult eating behavior. We do not knowingly collect personal information from children under 13. If we learn that we have collected personal information from a child under 13, we will take steps to delete it as soon as possible.

Certain U.S. states (Texas, with additional states pending) have enacted laws requiring app stores to verify user ages and obtain parental consent for minors. Metabyl supports these laws in the following ways:

• The app is designed for, and clinically targeted at, adult users
• We honor age signals provided by app stores (Google Play, Apple App Store) where applicable
• In-app purchases are routed through the app store's parental approval flow when the user is identified as a minor in an applicable jurisdiction
• We assign age ratings to in-app subscription products consistent with applicable state laws

If you believe a user under 18 has registered for Metabyl without parental consent, please contact us at support@metabyl.com to request account removal.

9. International Data Transfers

Your information may be processed and stored in countries outside your country of residence, including the United States, where data protection laws may differ. We take steps to ensure that your information receives adequate protection in accordance with applicable laws, such as through standard contractual clauses or other safeguards.

The App may contain links to third-party websites or services, such as fitness trackers or recipe databases. We are not responsible for the privacy practices or content of these third parties. We encourage you to review the privacy policies of any third-party services you use.

11. Changes to This Privacy Policy

We may update this Privacy Policy from time to time to reflect changes in our practices or legal requirements. We will notify you of material changes by posting the updated policy in the App or by other means, such as email. The "Last Updated" date at the top of this policy indicates when it was last revised. Your continued use of the App after such changes constitutes your acceptance of the updated policy.
